WEC PowerShift Participation Terms and Conditions

1. Program Description

WEC's electric vehicle flexible load program, PowerShift (the Program) reduces transmission and capacity costs for all WEC members by managing load during peak times. These peak times are 4-9 PM daily and may change in the future, with advance notice. Participating members may receive a participation incentive by allowing communication with their level II charger (charger) or with their electric vehicle (EV) charging interface.

A member consents and agrees to these terms and conditions by electing to participate in the Program.

2. Eligibility

WEC members who meet the requirements below are eligible to participate in the Program:

  • Residential WEC members who own or lease an eligible charger or EV and provide proof of ownership or lease terms showing EV registration at a residential location served by WEC.
  • Plug-in hybrid cars and electric motorcycles are not eligible for this Program. Eligible EVs and chargers are listed here.
  • Charger must be installed at a residential location served by WEC.
  • The member's residence must be occupied year-round.
  • The member's residence must have Wi-Fi with signal strength of at least "two bars" at the location where the charger is to be installed or EV is to be parked.
  • You must have a smart phone or tablet.
  • The charger must be (or have been) installed by a licensed electrician.

3. Program Procedures and Enrollment Rebate

There are three ways members can participate in the Program.

  1. Members who have previously enrolled in PowerShift under the agreement (https://www.washingtonelectric.coop/wp-content/uploads/2026/01/Example_DocuSign_PowerShift_ParticipantAgreement.pdf) and received a WEC provided charger and/or the Installation Rebate provided by Efficiency Vermont may be eligible to receive the Participation Incentive of $10/month from WEC upon agreeing to these updated terms. Members who were previous participants in PowerShift that are enrolling their charger are ineligible for the $100 enrollment incentive.
  1. For members who do not yet own a level II charger: WEC will provide a complimentary charger. A $500 cash rebate (Installation Rebate) may be available from WEC, funded by Efficiency Vermont, subject to the availability of funds. Efficiency Vermont in its sole discretion may change the amount and/or availability of the Installation Rebate without notice. If the Installation Rebate is available, you will receive your rebate from WEC in the form of a bill credit within 60 days after verification that the charger is connected to WEC's Communications Platform. Each WEC household is limited to (2) complimentary chargers and (2) Installation Rebates. Members are responsible for paying for the total cost of installation of the charger by hiring a licensed electrician of your choice.
  1. For members who already own an eligible charger or an eligible EV: Once members connect to WEC's Communications Platform, via their charger or EV, WEC may provide a one-time $100 sign-up rebate (Enrollment Rebate), funded by Efficiency Vermont, subject to the availability of funds. Efficiency Vermont in its sole discretion may change the amount and/or availability of the Enrollment Rebate without notice. If the Enrollment Rebate is available, you will receive your rebate from WEC in the form of a bill credit within 60 days after verification that the charger is connected to WEC's Communications Platform. Each household may only obtain Enrollment Rebates, if available, for a maximum of 2 EVs.

4. Participation Incentive

Participating members will receive a bill credit of $10/month from WEC, provided you do not charge during designated peak times (presently 4:00 p.m. to 9:00 p.m. daily) at any time during that month. Participating members will not receive a monthly incentive if WEC's Communication Platform indicates that any charging took place during a peak time. Participating members reserve the right to charge during peak hours on the understanding that they will not receive the monthly incentive for that period.

5. Connection to Electric Vehicle (EV) or charger and Consent to Data Usage

If you are eligible to participate in the Program, you must enroll your EV or charger in WEC's Communications Platform, which enables WEC to connect to your EV or charger for the limited purpose of providing WEC and/or the software provider with energy usage and EV battery charging data. EV battery charging-related data may include energy usage data, geolocation data (charging location(s)), and battery state of charge data.

As part of the Program, you consent to WEC, Efficiency Vermont, and the software provider retrieving, storing, analyzing, and otherwise using this data. This information will be used to assist in programming, analyzing, and monitoring the charger or the charging of your EV, and for other uses consistent with WEC's Privacy Policy (https://www.washingtonelectric.coop/wp-content/uploads/2013/03/Policy-841.pdf) and Efficiency Vermont's Privacy Policy https://www.efficiencyvermont.com/about/privacy-policy/. Data will be aggregated or otherwise altered to ensure anonymity when used for any public reporting of the results of the Program.

6. Term

This Agreement begins upon the day that you receive the charger or enroll your EV and will continue until you elect to discontinue participation in the Program or until WEC ends the Program.

7. Termination

Your participation in the Program will terminate in the event that:

  • you do not enroll the EV or charger within 90 days (or within 90 days of your move-in date if you move during the Term), or
  • if at any point prior to the end of the Term, WEC's Communication Platform is unable to communicate with or connect to the EV or charger and communication or connection is not restored by you within 45 days after notice from WEC, or
  • if at any point prior to the end of the Term, you move out of WEC territory, or
  • you elect to terminate this Agreement and give 45 days-notice to WEC by contacting WEC at info@wec.coop

8. Member Responsibility for Repair and Maintenance

You remain responsible for the repair and maintenance of your EV and charger. This Agreement does not alter your responsibility. Neither WEC nor Efficiency Vermont shall be responsible under any circumstances for the repair and maintenance of your EV or charger.

9. No Warranty or Representation

Neither WEC nor Efficiency Vermont make any warranty or representation, whether express or implied, statutory or otherwise, including but not limited to including any warranty of merchantability, noninfringement, or fitness for a particular purpose.

10. Liability

To the extent permitted by law, neither WEC nor Efficiency Vermont shall be liable for any direct, indirect, special or consequential damages to any persons or property resulting from or arising out of the use, repair, delay in repairing, replacement of, modification to, unavailability of, or performance of the EV or charger. Neither WEC nor Efficiency Vermont shall be responsible for any costs related to the repair, maintenance or replacement of the EV or charger.

11. Indemnification

Except to the extent caused by WEC's own negligent or intentional acts, you shall defend, indemnify, and hold WEC harmless from any claim, injury, or damages to any persons or property arising from your use of the EV or charger.

Except to the extent caused by Efficiency Vermont's own negligent or intentional acts, you shall defend, indemnify, and hold Efficiency Vermont harmless from any claim, injury, or damages to any persons or property arising from your use of the EV or charger.

12. Applicable Law

This Agreement is governed by the laws of the State of Vermont, and venue limited to the State of Vermont.

13. Modification of Terms

WEC may modify these terms or terminate this Program at will.

14. Electronic Communication

As a participant in the Program, you consent to receive communications from WEC electronically. You agree that any agreements, notices, disclosures or other correspondence provided by WEC in electric format satisfy any legal requirement that such communication be in writing.
